Terms of Service

These Terms govern your access to and use of Pickstuff. By creating an account or using the service, you agree to these Terms.

1. Who We Are

Pickstuff provides software for collecting customer feedback, managing ideas, prioritizing roadmap work, communicating releases, and using AI-assisted workflows. In these Terms, "Pickstuff", "we", "us", and "our" refer to the Pickstuff team operating the service.

2. Your Account

You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate account information and promptly update it when it changes. You may not share access in a way that avoids plan limits, security controls, or billing requirements.

3. Workspace Data and Customer Content

You retain ownership of the content you submit to Pickstuff, including feedback, ideas, comments, company records, contacts, roadmap data, and files. You grant us the rights needed to host, process, transmit, display, secure, back up, and otherwise operate Pickstuff for you.

You are responsible for ensuring that you have the necessary rights and notices to upload or process personal data, customer feedback, or third-party content in Pickstuff.

4. AI Features

Pickstuff includes AI-assisted features such as summarization, description improvement, tagging, sentiment analysis, similar idea detection, response drafting, and competitive intelligence. AI output may be incomplete, inaccurate, or unsuitable for your use case. You are responsible for reviewing AI-generated output before relying on it or sending it to customers.

If you connect your own AI provider or integration, your use of that provider may also be governed by the provider's terms and privacy documentation.

5. Acceptable Use

You may not use Pickstuff to:

  • Violate laws, regulations, privacy rights, intellectual property rights, or contractual obligations.
  • Upload malicious code, attempt unauthorized access, bypass security controls, or disrupt the service.
  • Send spam, phishing, deceptive, abusive, or unlawful communications.
  • Process highly sensitive personal data unless you have a lawful basis and appropriate safeguards.
  • Reverse engineer, scrape, benchmark, resell, or misuse the service except as permitted by law or by written agreement.

6. Integrations and Third-Party Services

Pickstuff may connect with services such as Slack, Jira, Linear, HubSpot, Stripe, ChartMogul, AI providers, email services, and other tools. You are responsible for configuring integrations correctly and for complying with each third-party service's terms. We are not responsible for third-party services, outages, changes, or data handling outside Pickstuff.

7. Plans, Billing, and Trials

Some Pickstuff features may be free, in early access, or subject to a paid plan. Paid plans, trials, limits, renewals, and taxes are described at checkout or in your account. Unless otherwise stated, fees are billed in advance and are non-refundable except where required by law.

We may change plans, limits, or pricing with reasonable notice. If you do not accept a change, you may stop using the paid service before the change takes effect.

8. Early Access and Changes

Pickstuff is in active development. Features may change, be added, or be removed as we improve the product. Early access and beta features may be less stable than generally available features.

9. Suspension and Termination

You may stop using Pickstuff at any time. We may suspend or terminate access if you violate these Terms, create security risk, fail to pay applicable fees, or use the service in a way that could harm Pickstuff, our users, or third parties. Where practical, we will provide notice and an opportunity to resolve the issue.

10. Disclaimers

Pickstuff is provided "as is" and "as available". We do not promise that the service will be uninterrupted, error-free, secure against every risk, or fit for every particular purpose. To the extent permitted by law, we disclaim warranties that are not expressly stated in these Terms.

11. Limitation of Liability

To the extent permitted by law, Pickstuff will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities. Our aggregate liability for claims relating to the service is limited to the amount you paid to Pickstuff for the service in the three months before the event giving rise to the claim, or EUR 100 if you used only free services.

12. Updates to These Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you. Your continued use of Pickstuff after updated Terms take effect means you accept the updated Terms.
